The following terms apply to Generative AI Preview Products:

Definitions. “Generative AI Preview Products” means Google Cloud Platform’s generative AI products or features that are designated as Preview. “Generated Output” means the data or content generated by a Generative AI Preview Product prompted by Customer Data. Generated Output is Customer Data. As between Customer and Google, Google does not assert any ownership rights in the Generated Output, provided that the Generated Output does not contain any pre-existing Google intellectual property.

Additional Use Restrictions. Unless permitted by Google in writing, Customer will ensure that Customer and its End Users will not:

• use a Generative AI Preview Product for commercial or production purposes.
• disclose Generated Output to a third party.
• use a Generative AI Preview Product as part of a website, Customer Application (as defined in the Agreement), or other online service that is directed towards or is likely to be accessed by individuals under the age of 18.
• use a Generative AI Preview Product for clinical purposes (for clarity, non-clinical research, scheduling, or other administrative tasks is not restricted), to provide medical advice, or in any manner that is overseen by or requires clearance or approval from any applicable regulatory authority.
• use Generated Output to: (i) develop models that compete with any Service or Software (as such terms are defined in the Agreement), or (ii) reverse engineer any Service, Software, or their models (or extract any components of the foregoing).

For the purposes of Generative AI Preview Products, the Prohibited Use Policy located at https://policies.google.com/terms/generative-ai/use-policy, as may be updated from time to time, is incorporated into the AUP.

For the Generative AI Preview Products, the above are also deemed to be “Restrictions” or “Use Restrictions” as described in the Agreement.

For Preview features of Vertex AI Search: Customer may use only Customer Data and web domains that it owns or is authorized to utilize.

Disclaimers. Generative AI Preview Products use experimental technology, may provide inaccurate or offensive Generated Output, and are not designed for or intended to be used to meet Customer’s regulatory, legal, or other obligations. Customer acknowledges that a Generative AI Preview Product may, in some scenarios, produce the same or similar Generated Output for multiple Customers.

In addition to these terms, the Pre-GA Offerings Terms at https://cloud.google.com/terms/service-terms apply to the Customer’s use of the Generative AI Preview Products, as well as: (i) the terms of the agreement under which Google has agreed to provide access to the Google Cloud Platform to Customer, (ii) in the case of channel customers, the Google Cloud Platform Terms of Service located at https://cloud.google.com/terms, or (iii) in the case of public sector partners, the terms of the agreement under which Google has authorized that public sector partner to distribute or resell access to the Google Cloud Platform (the “Agreement”).
