Capitalized terms used but not defined in these terms have the meaning given to them in the agreement governing Customer’s use of Google Cloud Platform.

By opting in, Customer grants to Google the worldwide, non-exclusive, and royalty-free right, and instructs Google, to use, copy, and modify the Opt-in Data (defined below) solely for the following purposes: (i) ensuring that results are contextually relevant and high quality, (ii) diagnosing issues and validating model performance, and (iii) using aggregated, de-identified, or pseudonymized Opt-in Data to improve and develop the TTP Services and any Google Cloud Platform Services. Google will own all improvements, developments, and any associated intellectual property resulting from its use of the de-identified data. “Opt-in Data” means Customer’s prompts and Generated Output in a specific Project using the Pre-GA Offerings listed on this page: https://cloud.google.com/gemini-for-cloud/ttp/welcome (“TTP Services”). These opt-in terms apply only to Projects using the TTP Services, and do not apply to Projects using services that are generally available. CUSTOMER SHOULD NOT USE THE TTP SERVICES TO PROCESS CUSTOMER’S SENSITIVE CONFIDENTIAL INFORMATION, PERSONAL DATA, OR OTHER DATA SUBJECT TO LEGAL OR REGULATORY COMPLIANCE REQUIREMENTS.

Customer may opt out of providing Google with additional Opt-in Data via the instructions described at https://cloud.google.com/gemini-for-cloud/ttp/welcome. Once Customer’s request to opt out has been received, Google will initiate deletion of the Opt-in Data, however, Google may perpetually retain and use any de-identified data for the purpose described above.

Customer represents that it has obtained all necessary rights, approvals, and consents for Google to use the Opt-in Data as described in these terms.

In addition to these terms, the Additional Terms for Generative AI Preview Products at https://cloud.google.com/trustedtester/aitos apply to the Customer’s use of the TTP Services. With respect to the subject matter of these terms, these terms govern over any conflicting agreements.

By opting in on behalf of Customer, you represent and warrant that (i) you have full legal authority and the necessary rights to bind Customer to these terms; (ii) you have read and understand these terms; and (iii) you agree, on behalf of Customer, to these terms.
