Gemini Business Additional Terms of Service

These terms apply only to Gemini Business and do not apply to any Google Cloud Platform services, including Gemini Enterprise Edition.

To use Gemini Business (the “Service”), you must accept (1) the Google Terms of Service, and (2) these Gemini Business Additional Terms of Service (the “Additional Terms”). Terms that are not defined in these Additional Terms have the meanings given to them in the Google Terms of Service.

Please read these documents carefully. Together, these documents are known as the “Terms”. They establish what you can expect from us as you use our services, and what we expect from you.

We also encourage you to read our Privacy Policy to better understand how we collect, use, and protect your information.

1. Administrators, Organizations, and Teams

Organizational Use. If you are using the Service on behalf of an organization, an authorized representative of that organization must agree to these terms, as described in the “Using Google services” section of the Google Terms of Service.

Roles. You may create a collaborative workspace (“Team”) as an “Administrator.” As an Administrator, you control who can join your Team as an “End User.” You are responsible and liable for all acts and omissions of your End Users within that Team and for their compliance with these Terms. As an End User, your access to a Team is managed by that Team’s Administrator.

2. Payments

Payment Obligations. The Administrator is responsible for all fees and applicable taxes associated with their Team. All fees are based on our then-current prices.

Billing. By providing a payment method, the Administrator authorizes Google or its payment processor to charge all applicable fees. The Administrator must maintain complete and accurate billing information.

Price Changes. We may change our prices, but we will provide the Administrator at least 15 days’ notice before any changes take effect.

Late Payments. We may suspend or terminate access to the Service if fees are past due. All fees are non-refundable unless required by law.

3. Data Use

Your Content” means the content you submit to the Service and any generated responses. When you use the Service, we process Your Content in accordance with the Google Data Processing Addendum

Gemini Enterprise Starter Edition 

When you use the Gemini Enterprise Starter Edition of the Service (the “Starter Edition”), you instruct Google to use Your Content to provide, improve, and develop the Service and Google machine learning technologies. If you don’t want your future content submissions used to train our generative AI models, you can opt out in the Service settings.

To help with quality and improve the Service, human reviewers may read, annotate, and process Your Content in the Starter Edition. DO NOT SUBMIT SENSITIVE, CONFIDENTIAL, OR PERSONAL INFORMATION TO THE STARTER EDITION.

Paid Services and Trial Period

When the Service is being offered for a fee, it is considered a paid Service (“Paid Service”). When you initially sign up to use the Service, we may offer you a limited trial period (“Trial Period”) for no fee. 

For Paid Services and during the Trial Period, Google will not use Your Content to improve our products.

Service Data

We also collect data necessary to operate and maintain the Service, such as account information, billing history, direct communications and feedback, and usage details (including operational status, performance metrics, and other technical details) (“Service Data”). We process Administrator Service Data in accordance with our Privacy Policy and the Google Controller-Controller Data Protection Terms.

Communications. You may receive periodic communications from Google at the email address you used during the sign up flow and which is associated with your account, such as training and on-boarding materials, product tips and updates, event information and special offers related to Google products and services. You can stop receiving email communications by opting out via the unsubscribe link in the emails. Personal data we collect for communications is subject to Google’s Privacy Policy.

4. Using the Service

Accounts. You may sign in to the Service using a Google Account or a supported third-party identity provider. You are responsible for all activity that occurs under your account for the Service, including taking reasonable steps to keep it secure. For the purposes of enforcement, including suspension and termination, references to “Google Account” in the Google Terms of Service will be interpreted to mean your account for the Service.

Responsibilities for Agentic AI. The Service may include AI agents that perform tasks on your behalf. You are solely responsible for configuring these agents; authorizing their access to data, applications, and systems; supervising the agents; and for all actions they perform.

Connected Services. You may be able to access and interact with other services, software libraries, APIs, and content through the Service, including some provided by third parties. These offerings are subject to applicable terms and licenses, as described in the “Other content” section of the Google Terms of Service. You are responsible for your use of any third-party offerings and for complying with their applicable terms. Google does not operate, control, or endorse these offerings, and is not responsible or liable for them. When you sign in using credentials provided by a third party, we rely on that third party for necessary identity verification.

Limitation on Use. You agree that use of the Service is for trade, business, or professional purposes only.

5. Age Requirements

You must be 18 years of age or older to use the Service.
