This Google Cloud User Experience Research Panel Addendum (this "UX Addendum") is an addendum to Customer's Google Cloud Platform License Agreement, Google Workspace (formerly G Suite) Agreement or Google Cloud Master Agreement, or other agreement under which Customer uses Google Cloud Platform or Google Workspace (the "Google Cloud Agreement") entered into by Google and the entity or person agreeing to it ("Customer"). "Google" has the meaning given in the Google Cloud Agreement. Capitalized terms not defined in this UX Addendum will have the meanings given in the Google Cloud Agreement. If you are accepting on behalf of Customer, you represent and warrant that: (i) you have full legal authority to bind Customer to this UX Addendum and (ii) you agree, on behalf of Customer, to this UX Addendum. If you do not have the legal authority to bind Customer, please do not agree to participate in the UX Program.
1. Background
Google wishes to (a) conduct user experience studies with individuals in Customer's organization who use Google Cloud products ("Users") in order to research, analyze and improve the usability of Google's current and future cloud products and services, and (b) to operate the Google Cloud User Experience Research Program (the "UX Program") as described in this UX Addendum ((a) and (b) collectively, the "Purpose"). Participating in the UX Program will allow Customer to provide input into Google’s product development.
2. Customer Responsibilities
Customer will provide Google with contact information for certain Users who are at least 18 years of age, and authorizes Google to contact those Users about participation in the UX Program. Google will cease contacting any User who (a) indicates to Google that they do not wish to participate in the UX Program or (b) is identified by Customer as not wishing to participate in the UX Program. Further, Google will cease contacting all Users (temporarily or permanently) at Customer’s request.
3. Privacy Policy
Google will, and will ensure that its Affiliates, only use User contact details and other personal data they collect from Users in connection with the UX Program for the Purpose and, subject to the foregoing, as further described in Google’s Privacy Policy (available at https://www.google.com/privacy.html). No such data will be considered Customer Data (as defined in the Google Cloud Agreement).
4. Feedback
As part of the UX Program, Customer may provide feedback and suggestions about current and future cloud products and services to Google and its Affiliates, and they may use any feedback or suggestions provided without restriction and without obligation to Customer.
5. Miscellaneous
5.1 If there is a conflict between the terms of this UX Addendum and the remaining terms of the Google Cloud Agreement, then this UX Addendum will govern.
5.2 This UX Addendum is effective as of the date Customer agrees to participate in the UX Program and remains in force until terminated by either party with 30 days' written notice. Sections 3 (Privacy), 4 (Feedback), and 5 (Miscellaneous) will survive termination of this UX Addendum.
