Wherever the term, "Services" is used in the Google Maps Platform Service Specific Terms, it refers to both the Google Maps Platform Services and the Analytics Services. If there is a conflict between the terms, these Analytics Service Specific Terms will prevail.

In this Section (B) (Service Terms), "With any Map" means to (1) display Google Maps Content on, next to, or in a manner that is visually associated with any map, including a Google Map; or (2) link Google Maps Content to any map or link any map to Google Maps Content, unless the specific map being linked to is the source of the applicable Google Maps Content.

1. Roads Management Insights

1.1. Permitted Use. Customer may only use Roads Management Insights for road data analytics to improve the safety, efficiency, and sustainability of road networks and public utilities that it manages or in which it has a direct stake (e.g., for infrastructure improvements, systemic upgrades, and planning for future events or emergencies).

1.2. Exporting and Caching. Customer may temporarily export and cache StaticDuration, Duration, and SpeedReadingIntervals ("Applicable Google Maps Content") as well as related time stamps, display names, and route geometries or references ("Auxiliary Data"), but only if and as expressly permitted and described in the Analytics Services Order Form. Both exported and cached Applicable Google Maps Content are subject to Section 1.3 (Deletion Requirements).

1.3. Deletion Requirements

1.3.1. Exported and cached Content. Customer must delete any cached or exported Google Maps Content upon expiration of the Caching Period as defined in Analytics Services Order Form.

1.3.2. Created Content. If Customer creates any content using Applicable Google Maps Content, Customer must delete the Applicable Google Maps Content that was used to create content, upon expiration of the caching period, as described in the Analytics Services Order Form.

3.2 Permitted Use. Customer may use SVI Content solely to detect and analyze Assets or to evaluate Attributes specified in an Order Form for the use case specified in an Order Form ("Use Case"). For panoramic Imagery, Customer may only access Imagery: (i) within specific jurisdictions where Customer or End Users operate or (ii) within 100 meters of a particular address or location, each as specified in an Order Form.

3.3 Derivatives. As a limited exception to the general prohibition on creating content from Google Maps Content, Customer may derive images and Embeddings from SVI Content ("Derived SVI Content"). All Derived SVI Content is Google Maps Content. Derived SVI Content is subject to the same permissions and restrictions as Google Maps Content, except for the following:

a. Embeddings. As a limited exception to the prohibition on caching Google Maps Content, Customer may temporarily store Embeddings solely within an approved Google Cloud Platform environment to facilitate the Use Case. Upon the expiration or termination of this Agreement, Customer will immediately delete all cached Embeddings.

3.4. Use with AI Models. As a limited exception to the general prohibition on creating content from Google Maps Content, Customer may use SVI Content in connection with artificial intelligence models ("AI Models")(including to train or fine-tune models), subject to the following:

3.4.2. Customer-Trained Model. For purposes of the Agreement, Google does not assert ownership in a Permitted Model trained or fine-tuned by Customer using SVI Content ("Customer-Trained Model"). Notwithstanding the foregoing, Customer may only use a Customer-Trained Model in compliance with the Agreement and the following:

(a) Customer will host the Customer-Trained Model exclusively on Google Cloud Platform and will not export the model;

(b) Customer will retrain the Customer-Trained Model every 2 years with then-current SVI Content;

(c) Customer will not use the Customer-Trained Model: (i) to develop, operate, or improve any General Purpose AI Model, High-Risk AI System, or (ii) in connection with a Prohibited AI Practice (each, as defined in the EU Artificial Intelligence Act); and

(d) Nothing in this subsection gives Customer ownership or license rights to Google Maps Content.

3.4.3. End User Compliance. For purpose of the Street View Insights Services, End Users will include an individual or entity that Customer permits to use a Customer-Trained Model. Customer will ensure its End Users use the Customer-Trained Model in accordance with the Agreement.

3.5 Use Restrictions

3.5.1 Privacy. Customer will not use SVI Content to infer personally identifiable information about specific individuals.

(a) No Re-Identification. SVI Content may contain redacted elements (such as blurred faces or license plates). Customer will not, and will not permit any End User to: (i) attempt to restore, de-anonymize, or reverse-engineer any redacted content; or (ii) use machine learning, artificial intelligence, or other technology to extract personally identifiable information (PII) from the SVI Content. Any violation of this section constitutes a material breach of the Agreement.

(b) Notice and Consent. Customer is responsible for complying with all applicable laws, including privacy laws, related to its use of Services. Before using the Services to analyze SVI Content of private residential property, Customer will: (i) provide notice to its users that SVI Content may be evaluated to support Customer's operations; and (ii) when and to the extent required by such law, obtain consent from an authorized individual (such as the respective property owner or resident).

3.5.2 Third Party Access. Customer will not allow any third party to access SVI Content, except Customer may allow its authorized subcontractors to access SVI Content solely for the purpose of visualization through a Customer Application or other secure interface that is linked to the Provisioned GCS Bucket to facilitate the Permitted Use.

3.6 Registered GCP Project and SVI Content.

3.6.1 Registered GCP Project. Customer will only access the Services and process Google Maps Content, including SVI Content and Derived SVI Content, in a Registered GCP Project, using authorized Google Cloud Platform products, services, and environments. Customer may only write, copy, or store SVI Content and Derived SVI Content in a GCS bucket specifically provisioned by Google to Customer for the Street View Insights Services.

3.6.2 Deletion of Google Maps Content. Google Maps Content, including SVI Content, contained in a Registered GCP Project is subject to an automated deletion policy and the TTL/Retention Policy as follows:

3.7 Verification and Non-Compliance

3.7.1 Verification. Google may audit Customer’s models, including a Customer-Trained Model, SVI Content access, and storage activities upon a reasonable, good faith belief that Customer has materially breached the Agreement. If the audit reveals a material breach, Customer will pay Google’s reasonable audit costs.

3.7.2 Logs. Customer will maintain Cloud Audit Logs for all registered GCP projects associated with the Services.

3.7.3 Access License. Google may use Customer-Trained Models solely to verify Customer’s compliance with the Agreement in accordance with this section.

3.7.4 Non-Compliance. If Customer is non-compliant with the Agreement, the parties will use commercially reasonable efforts to resolve the issue in good faith during a 30-day informal dispute resolution period before Google exercises any termination rights.

3.8 Customer Detections. For clarity, any data and insights Customer independently gathers using the Street View Insights Services are "Customer Detections" (classified as Customer Data under the GCP Agreement). Customer may only use Customer Detections for internal business operations. Customer may not sell Customer Detections to any third party, and may not share or distribute Customer Detections to any third party, except to authorized Customer subcontractors supporting the Permitted Use.

Notwithstanding the foregoing, if Customer is designated as an authorized ISV in an applicable Order Form, Customer may distribute or sublicense Customer Detections to its designated End Customers solely as permitted in the Agreement.

3.9 Survival. Section 3 (Street View Insights) survives the termination or expiration of the Agreement (and any related agreements) for as long as any Customer-Trained Models exist.

The terms in this section apply if the Agreement authorizes the resale or supply of Analytics Services under a Google Cloud partner or reseller program. In such instances, the terms in this Section form part of the Google TOS and govern the provision and use of the Analytics Services. This Section does not apply to Google Maps Core Services.
