Google Cloud Express Mode (“Express Mode”) Terms and Conditions

These “Express Mode Terms and Conditions” are an addendum to the Google Cloud Terms of Service (the “Agreement”), and apply to Customer‘s use of Express Mode and products and services made available to Customer under Express Mode (“Express Mode Offerings”). Capitalized terms not defined in these Express Mode Terms and Conditions will have the meanings given to them in the Agreement.

1. Program.

1.1 Express Mode Offerings. While Express Mode Offerings are not Services or Software, Customer’s use of Express Mode Offerings is subject to the terms of the Agreement applicable to Services (or Software, if applicable), as amended by the Pre-GA Offerings Terms of the Google Cloud Service Specific Terms, and these Express Mode Terms and Conditions. Any provisions in the Agreement (including these Express Mode Terms and Conditions) that depend on Customer’s operation of a Google Cloud Platform account do not apply to Customer’s use of Express Mode Offerings.

1.2 Eligibility. Participation in Express Mode is available only to (a) new Google Cloud customers, over the age of 18 and (b) existing Google Cloud customers over the age of 18 with a Gmail account (i.e., using the @gmail.com domain) and a valid billing account. However, no federal, state, or local government entities of any jurisdiction are eligible to participate in Express Mode unless Google agrees otherwise in writing.

1.3 Term. Customer’s access to Express Mode Offerings starts when Customer clicks “I Agree” to these Express Mode Terms and Conditions (“Express Mode Effective Date”) and ends when: (a) Customer transitions its use of Express Mode Offerings to a standard Google Cloud account as described in Section 4, (b) Google discontinues Express Mode or Customer’s access to Express Mode under Section 3.8 (Discontinuation or Updates), or (c) the Agreement terminates, whichever occurs first. Customer may also choose to stop using Express Mode at any time.

2. Additional Payment Terms.

2.1 Free Tier. The Free Tier for Express Mode is available only to new Google Cloud customers who have not previously held a Google Cloud customer account. Those new Google Cloud customers may use Express Mode Offerings only up to their specified free usage limits, which will be set out in the applicable Express Mode Offering Documentation and which may be updated from time to time. Changes to free usage limits will become effective 30 days after they are posted to the applicable Express Mode Offering's Documentation. To use any Express Mode Offering in excess of the applicable free usage limit, new Google Cloud customers must transition all use of the relevant Express Mode Offering to the Paid Tier as described in Section 2.2.

2.2 Paid Tier. Existing Google Cloud customers will begin their use of Express Mode Offerings in the Paid Tier. New Google Cloud customers will transition to the Paid Tier when they associate an eligible and valid form of payment with their Account and enable billing. Use of Express Mode Offerings in the Paid Tier is subject to the Payment Terms of the Agreement. Fees incurred or paid for use of Express Mode Offerings do not count toward any Google Cloud financial commitments.

2.3 Billing Address. For purposes of the Regional Terms Section of the Agreement, the billing address for Free Tier Customers who do not have a billing account and associated address will be the Country that Customer selected when agreeing to these Express Mode Terms and Conditions.

3. Limitations.

3.1 Business Purpose. Customer will use Express Mode Offerings solely for Customer’s trade, business, craft, or profession.

3.2 No Personal Data. Customer will not use the Express Mode Offerings to process personal data or other data subject to legal or regulatory compliance requirements.

3.3 Pre-GA Offering. Express Mode Offerings are Pre-GA Offerings subject to the Pre-GA Offering Terms and limitations specified in Google Cloud’s Service Specific TermsBY SIGNING UP FOR, OR ACCESSING GOOGLE CLOUD SERVICES THROUGH, EXPRESS MODE, CUSTOMER ACKNOWLEDGES THAT IT HAS READ, UNDERSTANDS, AND IS BOUND BY THOSE PRE-GA OFFERING TERMS, INCLUDING THEIR RESTRICTIONS ON PERMISSIBLE DATA, DISCLAIMERS OF REPRESENTATIONS AND WARRANTIES, AND LIMITATIONS ON GOOGLE’S LIABILITY.

3.4 Use Restrictions / AUP. Customer may not use the Express Mode Offerings in any manner that violates the Agreement, including the Restrictions Section of the Agreement.

3.5 Limited Services. Express Mode Offerings provide only a limited subset of the functionality and features available in Google Cloud Services. Express Mode Offerings may be subject to their own, Service-specific rights and restrictions as further described in the express mode Documentation for that specific Express Mode Offering.

3.6 Resource Access and Management. Customer’s Express Mode resources are Google-managed, will appear in Google’s own inventory and will not be subject to the separate organizational level governance, otherwise available in standard Google Cloud, to protect the resource against improper activity. Therefore Google may manage and protect Customer’s Express Mode resources as it does its own Google Cloud resources. This will include Google monitoring the type, nature, frequency, and content of access to and use within Customer’s Express Mode resource, to monitor for, identify, manage, and resolve potential vulnerabilities, reliability needs, misuse, compromise, or security risks. Google will use this information solely for such purposes and will not otherwise use or disclose such Customer information. Customer agrees that this use is necessary because Customer, having no direct management over the Express Mode resource, is unable to perform these critical activities.

3.7 Credit Card. No credit card or billing information is needed to enroll in the Free Tier. A valid form of payment is required to enroll in the Paid Tier. If Customer’s form of payment expires or otherwise becomes invalid while Customer is enrolled in the Paid Tier, Customer’s account may be suspended until such issue is resolved.

3.8 Discontinuation and Updates. Google may with thirty (30) days’ notice to Customer (a) discontinue Express Mode or Customer’s access to Express Mode, or (b) update Express Mode at any time.

4. Upgrading to a Standard Google Cloud Account.

4.1 At any time after the Express Mode Effective Date, Customer may transition its managed Express Mode Project and resources into a standard Google Cloud account by choosing to opt-in to full Google Cloud capabilities when prompted in the Admin Console.

4.2 If Customer upgrades to a standard Google Cloud account, any unused credits associated with Customer's billing account will continue to apply according to their terms.

4.3 Customer’s continued use of the Services associated with the Express Mode Offerings after upgrading to a standard Google Cloud account is subject to Customer’s compliance with the Agreement, and these Express Mode Terms and Conditions will no longer apply to the transitioned resources.

5. End of the Express Mode Account.

Unless Customer has upgraded its resources to a standard Google Cloud account as described in Section 4, when Customer’s Express Mode Account access ends, Customer will no longer have access to the Express Mode Offerings or any associated Project or resources. For clarity, this will not affect an existing Customer's access to its standard Google Cloud account.

6. Miscellaneous.

6.1 Communications. Customer may receive periodic communications from Google at the contact information submitted or linked during the Express Mode sign-up and associated with the Account, such as training and on-boarding materials, product tips and updates, event information, and special offers related to Google Cloud products and services. Customers can stop receiving email communications by opting out using the unsubscribe link in the emails.

6.2 Modifications. Google may modify these Express Mode Terms and Conditions at any time. Modifications needed to comply with applicable laws or regulations or for security purposes will take effect immediately upon posting here; all other changes will take effect 30 days after Google posts the changes here or otherwise notifies Customer. If Customer does not agree to any update to the Express Mode Terms and Conditions, Customer may stop using Express Mode. Customer's continued use of Express Mode after an update will constitute Customer's consent to such update.

6.3 Governing Law. The Agreement’s governing law and dispute resolution provisions also apply to these Express Mode Terms and Conditions.

6.4 Survival. Sections 2.5, 3, 4.3, 5, 6.3, 6.4 and 6.5 will survive any expiration or termination of the Express Mode Terms and Conditions.

6.5 Precedence. In the event of a conflict between these Express Mode Terms and Conditions and the Agreement, these Express Mode Terms and Conditions will govern with respect to the Express Mode Offerings.

6.6 Definitions.

(a) “Account” means Customer's Express Mode account managed by Google.

(b) “Project” means the Express Mode Offerings configured by Google for use by Customer.
